Assuming he sold the games himself at Comiket, I believe that would make them technically unofficial, as opposed to being the kind of thing you can find in Gamestop. It's still illegal since I assume he holds some form of copyright, but it certainly isn't equivalent to pirating anime or music, either. @ M12: Manga adaptation?
